Terms and Conditions
1. Acquiring services provided by skyhost.ro implies acceptance of the Terms and Conditions of use. This acceptance occurs during the online ordering process, through the client's acknowledgment that they have read and understood these rules and operational clauses. According to Ordinance no. 130 of August 31, 2000, regarding the legal regime of distance contracts: "The consumer has the right to notify the merchant in writing that they renounce the purchase, without penalties and without invoking a reason, within 10 working days from receiving the product or, in the case of services, from the conclusion of the contract."
Application Method
The terms and conditions of use apply to all visitors of the website www.skyhost.ro as well as its clients who use the services. The purpose of these terms is to ensure that all users of skyhost.ro have the same rights and interests, in accordance with the applicable rules.
Skyhost.ro reserves the right to make changes to the Terms and Conditions of use at any time, without prior notice, and these can be accessed at any time on the website www.skyhost.ro, on the Terms and Conditions page.
2. To increase resources (such as RAM, CPU, or the number of simultaneous processes), the client will have the option to upgrade to a higher-tier plan.
If the integrity of the server or its proper functioning is affected by excessive consumption of a hosting account, skyhost.ro reserves the right to suspend the account without prior notice.
2.1 All hosting accounts are monitored by our systems to maintain server stability. If a hosting account uses a significant amount of resources, we will contact the client concerned to discuss this matter.
3. Mass correspondence (spam) via unapproved emails, including for advertising, commercial, or propaganda purposes, as well as sending letters containing obscene expressions, is prohibited.
3.1. Distributing information to recipients who have previously expressed a desire not to receive such information is prohibited.
3.2. Using provided informational resources (such as mailboxes, email addresses, web pages, etc.) as contact information for committing any of the above actions is prohibited, regardless of the network from which these actions were committed.
3.2.1. Using non-existent addresses at the time of email transmission is also prohibited.
3.3. Child pornography and any activities associated with it are strictly prohibited.
3.4. Placing information that insults the honor and dignity of other individuals is prohibited, except where ordered by a court decision. In such cases, the account will be suspended without the possibility of refund.
3.5. Using and distributing materials that violate copyright of any kind is prohibited.
3.6. Placing pornographic materials on the virtual web server is strictly prohibited.
3.7. Unauthorized attempts to access network resources, as well as participation in network attacks and hacking activities, are prohibited.
3.8. Overloading software or hardware, as well as network intermediate zones, to an extent that exceeds the necessary for the normal operation of servers and their components is prohibited.
3.9. Using IRC (chat), online bots, and other specialized programs that are incompatible with hosting services is prohibited.
3.10. Incitement to national, racial, or other hatred, including materials with fascist, Nazi, or terrorist content, as well as calls for overthrowing the existing regime in any country worldwide, are strictly prohibited.
4. All of our shared web hosting packages include backup solutions, ensuring data security by storing backups in two separate locations. We use JetBackup, which performs periodic backups every 24/48 hours to both internal and external storage.
It's crucial to note that while we make every effort to maintain the integrity of our backups, we cannot guarantee it completely. Therefore, we strongly recommend that our clients perform their own regular backups and store them in a secure external environment. The data in our backup services is kept on a rotating basis for a period of 30 days.
This dual approach provides greater data security, offering a safety net in case of unexpected incidents that could affect data integrity on the server. However, the final responsibility for keeping data safe lies with the clients, who should perform and manage their own backups.
If the account is deleted from the server due to more than 30 days of non-payment, the client may request site restoration from an older backup, if this operation is possible.
Account backups are typically retained for up to 90 days after the service is suspended or deleted.
4.1 For VPS services, the backup option (snapshots) is included and created once or twice a week.
4.2 Customers who own Dedicated servers do not benefit from free backup and configure their own backup creation.
The provider is not responsible for the loss of information hosted on the servers due to user actions, hacking attacks, or errors in applications that are not associated with the service. For example, the control panel is not part of the service and is not provided by us, as it is developed and offered by cPanel LLC.
5. On our servers, we use the Imunify 360 security tool to protect against malware and security threats. Imunify 360 actively scans user accounts for potentially harmful files and suspicious behavior to ensure server security and protect other users.
If malicious files are detected on your account that may pose a threat to the server or other users, we will promptly notify you. You are required to take action to clean and analyze the issue within 24 hours of receiving the notification and inform us accordingly.
In some cases, if the detected threat is deemed serious, we may immediately block your account. In such cases, we will contact you to provide additional information and assistance.
6. PROSTUDIO INVEST SRL does not assume responsibility for client-installed plugins, themes, and other CMS (Content Management System) components such as WordPress, Joomla, and others:
- the client is responsible for ensuring the security of their website by carefully selecting and regularly updating plugins, themes, and CMS installations.
- plugins, themes, and other third-party software installed by the client may introduce security vulnerabilities. Skyhost.ro recommends clients to stay informed about security best practices and promptly update software to mitigate potential risks.
Domain Name Registration and Renewal.
Domains are registered for a minimum period of 1 year and cannot be canceled after registration.
Domains with the .ro extension can be registered for up to 10 years.
All .ro domain registrations comply with the rules set by ROTLD, which can be found on the ROTLD website.
The provider acts as an intermediary for all domain extensions such as ".ro", ".md", ".com", ".eu", etc.
Correction of typographical errors in the domain name is not allowed. Once the domain name is registered or renewed, the provider will not refund any fees. The client is responsible for all data related to the registered domain name and must keep it up to date, complete, and accurate throughout the registration period.The provider only acknowledges the data provided by the client.
To transfer a domain name to another provider, the client must complete the current provider's form and submit it from the registered email address. After that, the client will receive a unique authorization code for the transfer. Requests for the transfer of domains, for which the transfer code cannot be obtained automatically through the provider's website, will be reviewed within 5 business days after receiving the transfer request.
Acceptance of the request and registration of a domain name does not mean that the provider recognizes the client's legal right to use the respective name, including in cases related to registered trademarks, company names, or well-known personalities.
The client agrees not to involve the provider in disputes caused by the use of the respective domain name and to fully indemnify the provider for all costs, expenses, and compensation initiated by third parties, including legal and attorney fees incurred by the provider due to the registration and/or illegal use of a domain name.
The domain renewal price may change annually according to market conditions.
Expired domains cannot be transferred to another registrar.
Expired domains enter a redemption period of 30 or 60 days (depending on the extension) and can only be renewed after paying the penalty and renewal fee. It is recommended to renew domains on time to avoid additional costs.
After the redemption period ends, the domain becomes available for registration by another person. A domain registered by another person cannot be recovered or renewed.
For the registration of certain domains, the presentation of identity documents or other documents may be required, depending on the domain extension.
International domains (.com, .net, .org, .biz, etc.), as well as new TLDs (e.g., .online, .srl, .web, etc.), may be considered premium domains by the registrar. Therefore, it is possible that during availability check, the standard cost of the extension will be displayed and ordered, but at the registration attempt, the cost may differ. In this case, a price offer is requested from the international registrar, and the client either pays the price difference or receives a refund of the standard amount paid.
Some international extensions, such as .DE, .IT, .ES, .EU, and others, may have specific renewal conditions, requiring renewal even a month before expiration.
The renewal of a .DE domain must be completed at least 3 days before the registration period expires. If this is not done, the domain will be automatically deleted, and its status will change to redemptionPeriod (lasting 30 days): .DE domain rules - https://www.denic.de/en/domains/de-domains/domain-guidelines .
The .IT domain requires renewal 30 days before the registration period expires. If the renewal is not completed 30 days before the registration period expires, the domain will enter the redemptionPeriod status, which lasts for 30 days. During this period, the domain can be restored, but this requires payment of additional fees.
PROSTUDIO INVEST SRL is not liable for indirect damages in the following situations:
- for any reason, error, or omission, the domain was not registered/renewed automatically at the time of payment receipt.
- however, PROSTUDIO INVEST SRL is obligated to refund the collected amount if the domain was not registered/renewed in time and cannot be recovered for the same value.
- the domain was suspended, deleted, or canceled for any reason by the international registrar or ROTLD.
- there are losses or damages resulting from interruption of domain access.
In case of significant damages resulting from the error of PROSTUDIO INVEST SRL, the maximum liability is limited to the amount paid by the client.
Domains .ro are subject to rotld.ro rules, international domains are subject to ICANN rules.
Delivery Policy.
The client agrees to pay in advance for our services, corresponding to the period for which they are provided. Invoices must be settled in advance, at the beginning of each billing period, within 10 business days from the issuance of the proforma invoice.
Prices displayed in euros do not include VAT; VAT (19%) will be added to the final invoice. The client agrees to prepay for the services by settling the proforma invoice and will receive the fiscal invoice in electronic format.
The renewal invoice for services will be issued 14 days before the due date. In case of non-payment, domains will expire on the due date, and hosting services will be suspended within 5 days.
Order cancel policy.
According to the provisions of Government Ordinance 34/2014, individual clients who are consumers have the right to withdraw from contracts for web hosting services within 14 days from the date PROSTUDIO INVEST SRL accepts the order. All sums will be refunded within 15 days from the date of withdrawal from the contract.
The following services are not included in the 14-day return policy: fees for domain name registrations, fees paid for licenses such as cPanel, LiteSpeed, Plesk, and any other activated license, services ordered as a reseller, and any other fees paid for optional services other than those in the standard offer.
